Terms of Service

Version 0.1.0-draft · Last updated

These terms govern your use of f8 Capital (the "Service"), operated by the company named in Contact (the "Company", "we", "us"). By creating an account you accept them. If you do not accept them, do not use the Service.

1. What the Service is

The Service is a simulated trading evaluation. You pay a fee to attempt a challenge on a simulated account. Prices, orders, positions and balances exist only inside our own simulation engine.

  • No real funds are traded, held, invested or custodied for you. We are not a broker, a dealer, an exchange, an investment adviser, a money transmitter or a bank, and nothing here is a brokerage, custody, investment or payment service.
  • No client money. Your fee is the price of an evaluation service. It is not a deposit, it is not segregated on your behalf, and it does not entitle you to any share of Company assets.
  • Nothing is advice. Market data, rule explanations, calculators, educational resources and support answers are information only. They are not investment advice or a recommendation to enter any transaction.
  • Rewards are performance fees. If you meet the published conditions, the Company pays you a performance fee out of its own funds, calculated from the simulated profit of your account under the rules in force for that account. There is no trading profit to distribute, because no trading takes place in any market.

2. Eligibility

To use the Service you must:

  1. Be at least 18 years old and have full legal capacity;
  2. Not be resident in, or accessing the Service from, a jurisdiction on our Restricted Countries list for the program you buy;
  3. Not be a person subject to sanctions administered by the United Nations, the United States, the United Kingdom or the European Union, and not act for such a person;
  4. Use the Service for yourself, under your own identity.

You declare your country of residence at sign-up. Declaring a country falsely is a material breach of these terms and grounds for termination without refund. We also apply a location check at the network level; it is a convenience, not a substitute for your declaration.

3. Your account

One person, one identity, one set of accounts. You are responsible for keeping your sign-in credentials secure and for everything done through your account. Tell us immediately if you suspect unauthorised access.

We may suspend or close an account that is used by more than one person, that duplicates another person's account, or whose declared identity cannot be verified.

4. Programs, fees and rules

Each program (its phases, profit target, loss limits, minimum trading days, reward split and cadence) is published before you buy. The full rule set, including the effect of any add-ons you select, is shown on the checkout page.

Rules are locked at purchase. When you buy a challenge we store a frozen copy of the rules that apply to it. Later changes to our published programs do not change an account you already hold. The exact rules for each of your accounts are always readable in the app.

Fees are shown in US dollars, inclusive of any discount applied by a coupon, and are charged before your account is created. Taxes, if any apply to you, are yours to account for. Refund conditions are in the Refund Policy.

5. How your account can end

An account ends when any of the following happens, as described on the account's own page:

  • Breach. Your equity falls below the daily loss floor or the maximum loss floor. Equity includes floating profit and loss, estimated round-turn commission and accrued swap on open positions. A breach is final for that account.
  • Time limit. A free trial account ends when its time limit is reached.
  • Inactivity. An account with no trade for the published inactivity period expires.
  • Pass. You meet the profit target and minimum trading days with no position open, and the next account in the journey is issued.
  • Closure by us. Under clause 6, 7 or 12.

A breach does not end your relationship with us. Where the program allows it, you can buy a reset, which issues a new account under the same frozen rules.

6. Prohibited conduct

The evaluation measures trading skill in a simulated venue. Because the venue is simulated, some behaviour that a live market would punish instead exploits us. The following are prohibited:

  1. Latency or feed exploitation — trading on the difference between our published price and another venue's, including tick-scalping our quote publication interval or acting on a price we have not yet updated.
  2. Arbitrage across accounts, persons or feeds, including opposite positions held on two of our accounts, or on one of our accounts and a third party's.
  3. Group or copy trading between different people, including account sharing, trading another person's account, or having your account traded by anyone but you.
  4. Exploiting a defect in the simulation, the pricing engine or the rules engine, rather than reporting it.
  5. Automated abuse — scripted order flooding, or any use of the Service designed to degrade it for others.
  6. Martingale and comparable gambling patterns, reviewed case by case, where the pattern shows the account is being used to buy a lottery ticket rather than to demonstrate skill.
  7. Fraud — chargebacks on fees for a service used, fake or borrowed identity documents, duplicate accounts, or false statements at onboarding or verification.

Where we identify prohibited conduct we may hold a pass for review, deduct the profit of the trades concerned, close the account, withhold an unpaid reward, or close every account you hold. We record what we found and why, and we tell you. You can dispute the finding through support.

The behavioural rules published on Trading Rules — quick strike, micro-scalping, news trading, open risk and consistency — are separate from this clause. They never end an account on their own; they change what counts toward a pass or a reward, by the amounts published there.

7. Verification

Identity verification is required before your first reward is paid, and may be required earlier where we are obliged to carry it out. The KYC & AML Policy describes what we collect and why. We may withhold payment of any reward until verification is complete and until the verified identity matches the account holder.

8. Rewards and payment

A reward is payable only when every published condition for that reward cycle is met, including the cycle's eligibility date, a flat account, completed verification, the minimum growth and the minimum reward amount. The reward breakdown — profit, each deduction and its reason, the split and the resulting amount — is shown before you claim and stored with the claim.

Rewards are paid to a payout method you have added and confirmed. New payout methods are subject to a cooling-off period before first use, and changes require a one-time code sent to your email.

We pay a reward as a performance fee. We do not hold a balance for you: your wallet in the app is a ledger of amounts owed and paid, not a deposit account.

Unless the Company publishes a specific service level for payouts in the app, no payout time is promised. Where a service level is published, it applies with the exclusions stated alongside it.

9. Availability

The Service is provided on an "as is" and "as available" basis. Simulated markets follow published session hours; outside them no order is accepted. We may suspend trading platform-wide to protect account integrity, for example during a price-feed fault. If we do, open positions are left as they are and we say so in the app.

We do not promise uninterrupted availability, and we are not liable for a trading outcome caused by an interruption, by your connection, or by a price feed defect. Where a defect of ours materially affects an account, tell support: we can adjust, reinstate or reset an account, and we record every such action.

10. Intellectual property

The Service, its software, its rule engine and its content are ours or our licensors'. You get a personal, non-exclusive, non-transferable right to use the Service while your account is open. You may not copy, resell, reverse engineer, scrape or redistribute any part of it, or use our market data outside the app.

11. Liability

Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

Subject to that: we are not liable for indirect, incidental, special or consequential loss, for lost profit (simulated or otherwise), for loss of opportunity, or for the value of a reward that was not earned under the published rules. Our total liability to you for all claims in any 12-month period is limited to the fees you paid us in that period.

12. Suspension, termination and changes

You can close your account at any time from Settings. Closing it ends any challenge in progress without refund.

We may suspend or terminate your access for breach of these terms, for conduct in clause 6, where a law or a sanction requires it, or where we exit a market. Where we terminate without cause, we refund the fee for any challenge you have not started to trade.

We may change these terms. Material changes are notified in the app and by email at least 14 days before they take effect, and the version and date at the top of this page always identify the text in force. Changes never apply retroactively to the frozen rules of an account you already hold.

13. Governing law and disputes

The governing law and the forum for disputes are stated in the Contact block below. Before starting a formal dispute, raise the matter through support so we can try to settle it: most disagreements are about a rule calculation we can show you in full.
